One of the men accused of raping LSU student Madison Brooks before she was hit by a car was arrested on charges of sexually assaulting a 12-year-old girl in 2020.

Kyvon Washington, 18, was arrested for first-degree rape a day after he was released on bail in the case of 19-year-old Madison Brooks, which charges Washington with third-degree rape.

Documents obtained by WBRZ say Washington was 15 years old at the time he allegedly raped a 12-year-old girl after she left a birthday party to go swimming at an apartment complex in Livingston County in May or June 2020.

The girl told the police that Washington tore off her towel and raped her in the apartment for about 30 minutes.

The 12-year-old was taken to the hospital, and Washington denied the allegations. The case was put on hold until a witness came forward on Friday and told investigators that she had seen Washington enter the room with the victim.

“She witnessed the defendant enter the victim’s bedroom but denied hearing any voices or sounds that could make her think someone was having sex,” the arrest report says. “She also stated that she didn’t hear anyone screaming.”

Ron Haley, Washington’s lawyer, pointed to the moment the witness made the statement after his client’s arrest.

“Mr. Washington and his mother cooperated with the investigation two years ago and law enforcement took no action,” Haley said. it is on the threshold of a probable cause.

Washington, along with two other men and a 17-year-old, has been charged in connection with Brooks’ alleged rape earlier this month.

Washington and a 17-year-old were charged with Brooks’ rape, while Everett Lee, 28, and Kaysen Carver, 18, were charged with third-degree rape of principle, meaning they were witnesses but did not participate.

Brooks got out of the car after the alleged rape and was hit by another vehicle, but Haley’s lawyer said Brooks, who police said had a blood alcohol level of 0.319, four times the legal driving limit, got out of the car on own desire. .

“They didn’t just throw her out of the car,” Hailey told WAFB. “They didn’t force her to get out of the car,” he added, saying one of the videos showed her getting out. “I think at some point one of the others tries to calm the situation down and says, ‘Look, just get back in the car.’ She does not want”.
