The fish market worker who mortally wounded the man has so far only been charged with assault by the Manhattan District Attorney.

A Harlem fish market employee who told reporters he “didn’t mean to hurt” the man he fatally stabbed after a wild fight over shrimp is currently not charged with murder as prosecutors continue to investigate.

Junior Aquino Hernandez, 34, was arraigned on assault charges in Manhattan Criminal Court Thursday after initially being charged with murder, assault and possession of a weapon in connection with the death of Malik Burrell, prosecutors said.

On the eve of his 25th birthday, Malik was killed Tuesday night in a stabbing in which he and 29-year-old brother Bobby Burrell got into a fight with employees after the older man had previously gotten into a fight in a store.

Around 9:30 p.m., Bobby entered the express fish market in St. Nicholas Square off 155 W. Street and ordered shrimp after getting into an argument with an employee, prosecutors said.

Bobby grabbed the shrimp from the counter and tried to leave without paying, but prosecutors said he was followed to the door by an employee who tried to snatch the clams back.

The man dropped a shrimp and punched a worker in the face as the struggle spilled onto the pavement.

Bobby eventually left, but returned with Malik about four minutes later, and the brothers made their way behind the counter, prosecutors said.

Malik repeatedly hit the man his brother had just fought when Hernandez tried to separate them.

When he failed to separate the two, Hernandez grabbed a nearby kitchen knife and plunged it twice into Malik’s torso, prosecutors allege.

“My client informed me that he was defending a colleague who was severely beaten by two brothers,” defense attorney Lauriano Guzmán said. “My client’s defense is that he acted in self-defense.”

As Bobby was dragging his mortally wounded brother to the front of the store as employees kicked them out, prosecutors said Hernandez stabbed him three times in the arm and stomach, according to prosecutors.

Both brothers were taken to a Harlem hospital, where Malik died and Bobby was treated for a collapsed lung.

The employee allegedly beaten by Malik was also hospitalized. He was treated for cuts on his head and face, a broken tooth, and staples on his scalp.

Bobby was charged Thursday with robbery, burglary and assault for his role in the chaos.

A Manhattan criminal judge has ordered Hernandez’s supervised release as prosecutors continue to investigate the case and determine whether the original charge of stabbing and murder was justified.

The Burrells’ father criticized the district attorney’s decision.

“Are you telling me that this guy will get away with killing my son?” he said during the night vigil on Thursday. “I killed him in cold blood and stabbed his brother. Like, are we serious?”
