An NYPD captain has been fired after a lawsuit accusing him of raping an officer at Yankee Stadium.

An NYPD captain charged in a lawsuit over an officer’s rape at Yankee Stadium has been fired, Daily News has learned.

Capt. Jeffrey Brienza, 49, was fired in October after pleading guilty to administrative charges, though an NYPD spokesman said details of the charges would not be made public as he is no longer a police officer.

News reported in December 2021 that 47-year-old officer retired from service a month earlier because Brienza had allegedly raped her repeatedly in the stadium where they were both appointed to the coveted position.

Fred Lichtmacher, a lawyer for the alleged victim, now 49, said the firing was justified.

“This couldn’t have happened to a more deserving person,” Lichtmacher told The News on Tuesday. “It’s a pity it took so long, but bravo to the police department. Let’s look at it when the cops are charged.”

The officer who quit alleges in the Bronx Supreme Court lawsuit that Brienza first raped her after working in a bathtub at the Bronx Stadium in June 2020 and then continued to coerce her for more than a year after that. Her claim is still pending.

“There were times when it seemed to me that it was endless,” the former police officer, who asked not to be named, told The News. “I cried many times. I’m just wondering how I’m going to get out of this. I didn’t see the end. I felt so stuck. … I just felt so useless and aimless.”

When the 20-year veteran began work on the stadium, Brienza made her his personal driver and insisted she run errands for him, then allegedly attacked her in the bathroom three months after she was appointed.

“He grabbed me by the waist from behind,” the pensioner recalls. “I grabbed him and I took his hands off my waist and I felt his grip tighten and in that moment I realized what he was doing so I said no. He said yes.’ “

The mother-of-three alleges that Brienza forced her to perform oral sex on him, then pushed her to the sink and raped her, the lawsuit says.

“Many things went through my head,” the officer recalled. “I kind of blamed myself, like I could scream louder.”

Brienza later admitted to her that he might be in trouble if she told anyone about what had happened, the former police officer said.

“Everyone thinks he’s a great guy,” she said at the time. “Everyone loves him. I was new to the stadium. I was afraid to say anything because he is the captain.

The alleged abuse continued, with Brienza forcing her to perform oral sex on him in his office or in her car, sometimes more than once a day, the lawsuit says.

After informing the union representative of what was happening, the Internal Affairs Bureau opened an investigation, and Brienza was transferred to the 25th Precinct in East Harlem.

Brienza could not be contacted for comment on Tuesday, and his former union representative did not respond to a request for comment.
