‘Rust’ Assistant Director Countersues Alec Baldwin: ‘Active and Primary Negligence’

Actor Alec Baldwin is being countersued by “Rust” assistant director Dave Halls following the death of cinematographer Halyna Hutchins on the set of the film.

According to The Hollywood Reporter, Halls has countersued Baldwin and other crewmembers, claiming their “active and primary negligence” led to the incident.

The outlet noted Halls’ lawsuit, filed in Los Angeles Superior Court last week, was sparked as part of litigation that began with script supervisor Mamie Mitchell, who took legal action against Baldwin as well as 22 other producers, production companies, financiers and crewmembers.

According to the Reporter, if Mitchell proves to be victorious with her lawsuit, Halls says Baldwin, armorer Hannah Gutierrez-Reed, prop master Sarah Zachry and ammunition supplier Seth Kenney should be held “liable for his apportionment of the fault,” as the outlet explained.

Additionally, Halls is seeking a court order that would make him entitled to compensation from them if he’s found liable.

“Each of the Cross-Defendants were negligently or tortiously responsible, in whole or in part, in some proportional relation to themselves and to Cross-Complainant, for the injuries, if any, allegedly suffered by Plaintiff,” the complaint states.

It continues, “Further, that in the event Cross-Complainant be judged jointly liable with Cross-Defendants, each Cross-Defendant herein be required to pay to Cross-Complainant a sum equal to the proportionate share of monetary payments, if any there be, made to Plaintiff.”

Halls’ countersuit also declares there was a breach of contract over the failure to “procure the required insurance” and name him part of the policy, per the report.

Last month, Baldwin filed a lawsuit to “clear” his name after he fired the prop gun, killing Hutchins, IJR reported.

The lawsuit states, “More than anyone else on that set, Baldwin has been wrongfully viewed as the perpetrator of this tragedy.”

Earlier this month, Baldwin’s wife, Hilaria, shared how the incident has impacted their family.

“We’re not okay. We can’t be okay. No one is okay. It was, and is, a tragedy that nobody could ever have imagined,” she said during an interview with Extra.

Hilaria added, “I mean, the loss of Halyna, she was an incredible woman in so many different ways.”
