Father of accused murderer Richard Acosta Jr found guilty of capital murder.

DALLAS (CBSDFW.COM) – While the 15-year-old accused shooter remains on the run, his father is now heading to prison for life without parole for a triple homicide, evidence prosecutors have called some of the most horrifying they have ever seen.

On Friday, in a Dallas courtroom, a jury found 34-year-old Richard Acosta Jr. guilty of capital murder. Prosecutors alleged that Acosta drove his son to and from a convenience store the night after Christmas 2021, where Abel Acosta shot and killed three teenage boys and wounded a fourth.

CCTV video showed him parked in front of the store while his shirtless son fired from the front door, however he claimed he didn’t know his son was involved, or that he even had a gun.

Acosta Jr. did not react to the announcement of the verdict. Some family members quickly left, crying. Later, they yelled briefly to reporters who followed them to the elevators, asking where Abel Acosta was.

Rudy Herrera, whose 14-year-old brother Xavier Gonzalez was killed that night, called the sentence “half the justice” her brother deserved.

“And I hope that Abel will also be held accountable to the others, and Xavier will receive the justice he deserves, like the other victims,” she said.

Ivan Noyala, 16, and Rafael Garcia, 17, were also killed that night.

Dallas District Attorney John Crusoe, who made the prosecution’s closing argument, said he did not expect Acosta Jr. to now release information about his son’s whereabouts.

“He could have done it earlier if he wanted to,” Creso said. “And he decided not to do it. He threw the dice.”

Garland Police Chief Jeff Bryan said he agreed with the family that the verdict was half fair.

“In order to achieve full justice, we need Abel Acosta to be in custody,” he said. “And we need help to take him into custody. But our mission will not be accomplished until that happens.”
