District Attorney Wise is seeking the death penalty for Tanner Horner, who is charged with the murder of Athena Strand.

WISE COUNTY, Texas (CBSDFW.COM) Wise County District Attorney James Stainton said he intends to seek the death penalty for Tanner Horner, the man accused of killing seven-year-old Athena Strand late last year.

Horner was accused February 16 for the kidnapping and murder of a person under 10 years of age under aggravated circumstances. Stainton filed a notice of intent the next day.

The 31-year-old FedEx driver confessed to kidnapping Strand in his driveway and then killing her within an hour of the Nov. 30 abduction.

Wise Lane County Sheriff Akin said that shortly before Strand’s stepmother realized she was missing, Horner left a package with a Christmas gift at their home in Paradise, Texas. He was later tracked down using digital evidence.

Two days later, Strand’s body was found about nine miles from her home.

Strand’s mother, Maitlyn Gandhi, released the following statement following his indictment:

“I would like to thank the Wise County Grand Jury for their role in this process. Hearing the facts and circumstances of the abduction and murder of my 7-year-old daughter was undoubtedly very difficult for them. I want them to know that their work is deeply appreciated.

Tanner Horner’s indictment is the start of a long journey through the justice system. I appreciate the constant support of everyone and for preserving the name and memory of Athena. Please take a moment to hug your children and loved ones. No one promises another day.”

The estimated time frame for a capital murder case is between 18 months and two years.
