Alec Baldwin is expected to be charged on Tuesday with manslaughter on the set of the film.

SANTA FE, New Mexico — Prosecutors planned Tuesday to file a manslaughter charge in connection with the fatal shooting of cinematographer by actor Alec Baldwin during a rehearsal on the set of a Western in 2021.

The district attorney said through a spokeswoman on Monday that her office would release the indictment documents and a statement of probable cause outlining the evidence. Hutchins’ death has already led to new precautions in the film industry.

Manslaughter may include homicide that occurs when the defendant does something legal but dangerous and acts carelessly or recklessly. Special Counsel Andrea Rib cited a pattern of “criminal disregard for safety” on the set of Rust.

Prosecutors also said they would release the terms of a signed plea agreement with assistant director David Halls, who oversaw security on the set. Participants in the unfilmed rehearsal gave conflicting accounts of who passed the weapons to Baldwin.

Heather Brewer, a spokeswoman for the district attorney’s office, said in a statement Monday that prosecutors are “fully focused on bringing justice to Halina Hutchins” and “the evidence and facts speak for themselves.”

Baldwin, also Rust’s co-producer, called the murder a tragic accident. The 64-year-old actor said he was told the gun was safe and tried to clear his name by suing the people who handled and supplied the loaded .45 revolver.

In his lawsuit, Baldwin said that while working on camera angles with Hutchins, he pointed the gun in her direction, drew back, and released the weapon’s trigger, which ran out of juice.

Defense attorney Jason Bowles, representing Gutierrez-Reid, said the allegations are the result of a “flawed investigation” and “an inaccurate understanding of all the facts.”

Defendants can participate remotely in many of the original trials or seek a waiver of their first appearance.

Negligent manslaughter is a fourth-degree felony punishable by up to 18 months in prison and a $5,000 fine under New Mexico law. The second set of manslaughter charges involve recklessness with a provision that could lead to a mandatory five years in prison because the crime was committed with a firearm.
