The lawyer of the ex-officer accused in the Tyre Nichols case reacted to the published video

Following the release Friday of video footage showing a deadly confrontation between Tyre Nichols and five Memphis police officers, the attorney for Desmond Mills Jr., one of the five police officers who was charged with his murder, said a “thorough investigation” of all available angles of the video was needed before “providing context or comment”.

“Mr. Mills and I will review these videos together at the appropriate time,” lawyer Blake Ballin said in a statement to NewsNation. “Before providing context or commentary, all available points of view must be carefully considered. My heart goes out to the Nichols family and the city of Memphis, and we hope they all speak out peacefully.”

The video shows officers tasing him and then punching, kicking and kicking him after he tried to flee.

Nichols spent three days in the hospital after his arrest on January 7 before succumbing to his injuries on January 10.

Desmond and four other officers involved in the arrest – Demetrius Haley, Tadarrius Bean, Emmitt Martin III and Justin Smith – were fired by the Memphis Police Department last week and have all been charged with murder in the second degree along with aggravated assault, aggravated kidnapping, misconduct and official harassment.

All of the former officers surrendered to state authorities on Thursday, and by Friday morning, four had posted bail. According to FOX 13 Memphis, Haley was the last released officer.

The bail for each former officer was set at $250,000 to $350,000.

According to their lawyers, Mills and Martin plan to plead not guilty, while lawyers for the other three former officers could not be contacted, according to the Associated Press.

“No one wanted Tyre Nichols to die that night,” Martin’s lawyer William Massey said.

Shelby County District Attorney Steve Mulroy said on Thursday that all police officers were “responsible” even though they played different roles in Nichols’ arrest.

Nichols’ stepfather, Rodney Wells, told The Associated Press that they wanted to be charged with first-degree murder but were “okay” with second-degree charges. “There are other allegations, so I agree with that,” he said.

Memphis Police Director Serelyn Davis called the officers’ actions “disgusting, reckless and inhumane.”

Nichols’ mother, RowVon Wells, warned supporters of the “horrific” nature of the video before it was released, but begged for peace.

“I don’t want us to burn our city, smash the streets through the streets, because this is not what my son advocated,” she said on Thursday. “If you guys are here for me and Tyra, then you will peacefully protest.”

Second-degree murder is punishable by 15 to 60 years in prison under Tennessee law.
