Paxton files petition in Federal Court to overturn Biden’s illegal DACA rule

AUSTIN, Texas — Attorney General Paxton is building on his previous efforts to end President Biden’s illegal Child Deferral of Arrival (DACA) program by filing a motion for summary judgment in his case against the federal government.

The Biden administration’s new DACA program was created after Attorney General Paxton successfully canceled the original program created under the Obama administration. The New Orleans-based US Court of Appeals for the Fifth Circuit correctly ruled that President Obama had no legal authority to make policy, but that hasn’t stopped the lawless Biden administration from creating a rule that suffers from the same fundamental flaws. .

Biden’s DACA program, which allows some illegal immigrants to stay in the US indefinitely and provides them with many of the same legal rights and benefits as US citizens, is placing a huge burden on Texas and other states across the country. To stop the program, Attorney General Paxton filed a motion for summary judgment calling for the court to strike down the new rule, permanently ban its application, and declare it unconstitutional and illegal on several grounds.

“I have already successfully led the fight against Obama’s DACA program. I hope our judiciary once again wins over American sovereignty and proper executive checks and balances,” Attorney General Paxton said. “The programs of Obama and Biden are almost indistinguishable both in the negative harm they will cause to this country and in the illegal means used to implement them. Therefore, I am calling for the new DACA rule to end the same way as the Obama-era rule: it is declared illegal.”
