Driver accused of killing Charlotte Co. MP must pass proficiency test

Punta Gorda, Florida. A Charlotte County judge approved a motion for a mental health evaluation of a woman accused of beating and killing a Charlotte County deputy on I-75 in November.
Cassandra Smith faces multiple charges, including vehicular homicide. MPs say she hit and killed Deputy Christopher Taylor, who had been with the police force for less than a year, while drunk driving.

Smith’s lawyers argue that she needs a competency assessment due to her behavior in the courtroom and misunderstanding of the charges, among other reasons. Her lawyer said on Thursday that he was unable to communicate with Smith as her physical and mental condition worsened.

Rich Taylor, Christopher’s grandfather, says the assessment is a way to potentially get the charges off her.

“For me, it’s just a shortcut from her because it’s a clear case and they’re just trying to finish her off,” he explained.

Grandpa, along with other family members, attended the hearing on Thursday. Rich says he plans to be there for everyone to get justice for his grandson.

Smith did not appear in court, and lawyers say she is “on a business trip.” A Charlotte County MP in jail says it could mean a lot of things, like seeing a doctor or getting a transfer.

However, the deputy confirmed that she was still in county custody.

The next step in this phase is an assessment, during which the doctors will determine if Smith is fit to stand trial.

The next court session is scheduled for April 20.
