Colorado woman not facing jail time for rape and pregnancy by 13-year-old boy: report

A 31-year-old woman who admitted to having sex with and getting pregnant by a 13-year-old boy will reportedly not be serving a prison sentence, according to reports.

“I think if she was a man and he was a little girl, things would definitely be different,” the victim’s mother said. “They will look for more. I feel that since he is not a woman, neither are they. They pity her.”

The Fontana Police Department in Colorado arrested Andrea Serrano in June 2022 on felony charges of child sexual abuse by a proxy and child sexual abuse.

Serrano allegedly admitted to police that she had sex with a teenager whose identity is unknown due to his age, and they have placed her in the El Paso County Criminal Justice Center while her case continues.

But now Serrano can go free and is not facing jail time for her crime after she agreed to a plea deal with prosecutors who dropped the original charges in favor of a lesser crime that did not require jail time.

“I feel like my son’s childhood was stolen from him. Now he has to be a father.”

The deal, reviewed by KKTV in Colorado, would require Serrano to register as a sex offender, and she could face 10 years to life in prison under intense sex offender supervision.

The victim’s family is considering the next steps in the case as they believe his life has been irrevocably changed due to Serrano’s actions.

“I feel like my son’s childhood was stolen from him. Now he has to be a father. He is a victim and he will have to live with it for the rest of his life,” the victim’s mother told KKTV.

She demanded an explanation why Serrano was not facing jail time for her crime and said the family would seek sole custody of Serrano’s child, whose father is the victim.
