Son charged with healthcare fraud for allegedly neglecting elderly mother, found with maggots in wounds

Juan Santos Huerta, a 52-year-old man from Elmendorf, Texas, is facing charges of healthcare fraud, a felony offense. The charges stem from an alarming discovery that Huerta was working on the road instead of caring for his elderly mother, who tragically passed away due to his neglect. The investigation revealed that Huerta had defrauded the state of over $64,000 in Medicaid payments by submitting false time cards indicating he was providing care for his mother.

According to arrest paperwork, Huerta submitted more than 2,300 hours of timecards for the supposed care of his mother while he was actually working as a truck driver for various companies. This deception persisted for over four years, starting in April 2018 and ending with his mother’s death on September 4, 2021. Shockingly, investigators found that Huerta’s mother had suffered from neglect, malnourishment, exposed wounds infested with maggots, and necrosis in her extremities.

Further investigation revealed that Huerta had been employed by multiple trucking firms during the entire period of the alleged fraud, spanning from 2018 to 2021. Huerta admitted to a Bexar County Sheriff’s Office officer that he used tokens to falsely report hours of caregiving for his mother while actually working on the road. The victim’s extensive wounds and severe condition, combined with her unfortunate demise, point to an extraordinary level of neglect and the absence of the personal care services that Huerta was supposed to provide.

As a result of these shocking revelations, Juan Santos Huerta has been charged with healthcare fraud, a third-degree felony. He has been taken into custody and is currently held at Bexar County Jail on a bond set at $15,000. This case continues to develop as authorities delve deeper into the extent of the fraud and the tragic consequences it had for Huerta’s mother.
