Should child abusers receive the death penalty? DeSantis proposal could challenge SCOTUS decision

Speaking in Miami on Thursday, Florida Gov. Ron DeSantis proposed making those convicted of child rape eligible for the death penalty and requiring them to serve the minimum sentence of life in prison.

A Library of Congress report tells the case of a Louisiana man who was convicted of raping his 8-year-old stepdaughter and sentenced to death. His appeal eventually reached the Supreme Court.

In 2008, a court ruled that the death penalty as a punishment for child abusers was unconstitutional.

The ruling noted that “Louisiana has been the only state since 1964 to have anyone sentenced to death for a crime other than murder.” According to the LOC, the court concluded that “the death penalty is not a proportionate punishment for the rape of a child, and that the death penalty should be limited for crimes against the person to those that take the victim’s life.”

If DeSantis’ proposal goes ahead, it could force the Supreme Court to re-examine the decision.

The Republican governor also proposed removing the unanimous jury requirement for a death sentence. He suggested that a supermajority of the jury should be sufficient.

A Florida jury’s decision to spare the life of convicted murderer Nicholas Cruz, who shot and killed 17 people and wounded more at Marjorie Stoneman Douglas High School in Parkland, Florida, in 2018 puzzled DeSantis.

“Obviously he was guilty,” he said on Thursday. “And then you have, like, one juror who did not want to use the death penalty. … One juror cannot veto this. And I do not think that in this case justice has triumphed. If you are going to have capital [punishment]you must apply it to the worst of the worst crimes.”

DeSantis also said he believes in tougher penalties for fentanyl dealers who distribute the drug disguised as candy for kids. He hopes to strengthen existing bail laws in the Sunshine State.

Our criminal justice system has become too weak. Does anyone really believe that Nicholas Cruz deserves to live?

If your child was raped, shouldn’t the perpetrator at least spend the rest of his life in prison?

If your child died of fentanyl poisoning after ingesting what they thought was candy, you would release those responsible for its distribution or hold them responsible for your child’s death.

By loosening our standards a little here and a little there, the United States is left with a criminal justice system that cares more about the rights of the perpetrator than the rights of the victim. This needs to be changed.

I welcome DeSantis’ suggestions. Liberals, with a lot of help from billionaire George Soros, whose financial backing has resulted in far-left district attorneys being stationed all over the US, have taken over our criminal justice system and made America a more dangerous place.

We need bold leaders like DeSantis to change our country and bring about real change.
