‘Reverse Awake Law’: Florida bill targets employers who require transgender treatment

TALLAHASSEE, Florida. — On a new front in the fight to treat transgender people, a Republican in the Senate on Monday filed a proposal that could result in some employers being required to cover the costs to end treatment for gender dysphoria.

R-Spring Hill State Senator Blaise Ingola has filed a bill (SB 952) for consideration during the legislative session beginning March 7.

This comes after Governor Ron DeSantis’ administration blocked Medicaid coverage for treatments such as puberty blockers and hormone therapy for people with gender dysphoria. In addition, state medical boards have supported rules to prevent physicians from providing such treatment to transgender minors.

Ingolia’s bill, entitled “Reverse Awakening Law,” targets employers who cover the cost of gender dysphoria, which the federal government clinically defines as “significant suffering that a person may experience when the sex or gender assigned at birth does not match their personality.” ”

The bill would also require employers to cover the costs of canceling such treatment, if necessary.

“An employee who has received treatment for gender dysphoria under employer-provided coverage is entitled to that employer’s full coverage of the total costs associated with treatment that reverses treatment for gender dysphoria if the employee later determines that treatment for gender dysphoria is not appropriate for them.” or her and wants to change treatment, regardless of whether the person is currently employed by the same employer at the time of such decision,” the bill says.

Ingoglia indicated that the bill is for employers who pay for people traveling to other states for gender-affirming care.
