Paxton Seeks Over Half a Million Dollar Settlement After Magellan Terminals Holdings Violated Texas Clean Air Law

Austin, Texas — Attorney General Ken Paxton has reached a settlement with Magellan Terminals Holdings, LP over violations of the Texas Clean Air Act following a major fire at an oil terminal in Corpus Christi, Texas. Magellan paid the state $588,000 in civil penalties and $12,000 in attorneys’ fees to remedy these violations.

On the morning of December 5, 2020, a Magellan contractor was removing light crude oil from the bottom of a storage tank when a major fire broke out. The fire was quickly extinguished in the morning of the same day. Unfortunately, as a result of the explosion and fire, six contractors were injured, one subsequently died.

As part of its response and to prevent similar events in the future, Magellan submitted and implemented a corrective action plan approved by the Texas Environmental Quality Commission in a timely manner.

Magellan’s corrective action plan included banning the use of certain equipment during tank cleaning, implementing new tank cleaning procedures, and requiring contractors to use certain personal air monitors during tank cleaning.
