Paxton denounces Biden’s unconstitutional call to ban a specific type of firearm used daily by law-abiding Americans

Austin, Texas — Attorney General Paxton joined in a letter from the President of Montana to President Biden condemning his unconstitutional decision to call for an “assault weapon” ban during his State of the Union address.

Joe Biden has displayed a disturbing disregard for the Constitution throughout his presidency, and this recent call to disarm the millions of Americans who rely on this so-called “assault weapon” to protect their homes and families is no exception. To support this call, President Biden has rife in his speech with untruths and willful ignorance of any facts that might conflict with his political agenda. For example, while Biden claimed that the 1994 “assault weapon” ban reduced mass shootings, two Justice Department studies found that the policy had no measurable effect on violent crime. In fact, the only by-product of this policy was the disarmament of millions of Americans and the violation of their Second Amendment rights.

However, President Biden’s efforts to find workarounds for our Constitution will not go unanswered, as evidenced by Attorney General Paxton’s recent lawsuit against a new ATF rule targeting handgun owners who use stabilizing braces. Attorney General Paxton will continue to fight to uphold the Second Amendment for all law-abiding Americans.

The letter states: “In summary, the right to keep and bear arms is one of the most fundamental and deeply rooted freedoms in our constitutional tradition. It guards and defends the most fundamental of all rights, the right to life, and is a constant bulwark against tyranny. We stand ready to resist any attempt by your administration to trample on this fundamental constitutional right.”
