Paxton defends Florida law banning biological males from women’s sports

Austin, Texas — Attorney General Paxton has joined the Alabama-led amicus initiative in support of a Florida law to protect and support women’s sports by preventing biological men from competing with women. Florida is being sued because of the law, and the state has filed a motion to dismiss the lawsuit.

The amicus opinion, presented by a multi-state coalition, supports Florida’s proposal and state law, as well as longstanding biological sex determination. The Coalition contends that Plaintiff’s desire to expand the definition of “woman” to include biological men is unfounded and unlawful. For a court to accept a definition of gender based on so-called “gender identity” rather than biological gender would be a radical departure from social norms that would jeopardize the safety of all students. It would also create serious legal issues that could lead to increased discrimination and the potential reversal of all protections for girls in schools, such as separate bathrooms and changing rooms for women.

The summary states: “Furthermore, forcing states to define sex according to gender identity will jeopardize the ability of states to implement coherent gender-responsive policies. It may even force them to resort to gender stereotypes as they try to define “boy” and “girl” outside of biology. The Constitution does not require any of this.
