The defendant was taken into custody and is due to return to court on March 16, 2023. He is expected to be sentenced to 23 years in prison up to life in prison. The NCDA recommended a sentence of 25 years to life in prison.
“In just two weeks, in two separate incidents, Marvin Morales helped lure a young man into killing him and pointed a loaded gun at a police officer’s chest,” District Attorney Donnelly said. “This defendant, an alleged active member of MS-13, has consistently shown disrespect for human life. Thanks to today’s request, our county has become a safer place.”
According to the investigation, in the early morning of March 1, 2021, a co-defendant man allegedly contacted Daniel Garcia-Carbajal on social networks and invited him to chat with the girls. The 18-year-old victim was picked up by car and taken to Cow Meadow Park in Freeport. García-Carbajal entered the park with several people, including Morales, that day and received one shot in the head, resulting in his death.
A family member reported the disappearance of Garcia-Carbajal, and the next day his body was found in the park. The victim was considered an enemy of MS-13 due to his social media posts.
Cases are pending against co-defendants Tulio Ayala, Manuel Aparicio Gomez, Kevin Torres and Henry Canales in the death of Garcia-Carbajal.
On March 15, 2021, Morales was a passenger in a Hyundai SUV driving at high speed in a parking lot in Hempstead. Neighboring policemen turned on the headlights of their car, and the Hyundai did not immediately stop. The NCPD detective exited his vehicle and approached the Hyundai as Morales exited the passenger door and pointed a loaded pistol at the officer’s chest. Morales was arrested on the spot.
The case is being handled by the deputy head of the homicide division, Veronica Guarilla. Respondent represented by Scott Gross, Esq.
