(CNN) — Brian Lowndry’s mother wrote a letter to her son talking about getting a shovel and burying the body, a lawyer representing Gabby Petito’s parents said during a court hearing Tuesday.

The Petitos are sued by the Laundrymen for emotional distress over Gabby’s death while on a road trip with her fiancé, Brian.

An attorney for Petito’s parents, Patrick Reilly, said during a remote hearing in Florida’s Sarasota County District Court that he saw the letter at the FBI’s regional office and it said things “including how to help him get out of jail, get a shovel and some other things.” things.”

The envelope containing the letter was labeled “burn after reading,” according to Reilly, who said the letter had been removed from Brian Loundry’s backpack when his body was found.

Gabby’s remains were found in Bridger-Teton National Forest in Wyoming, and her death was ruled a homicide by strangulation by hand. According to the FBI, before committing suicide, Brian wrote in a notebook that he was responsible for Gabby’s death.

In court on Tuesday, Londry’s parents’ defense lawyer said the letter was unrelated to the lawsuit and they should not file it, but also confirmed that the letter exists and that another family lawyer has it.

“This document predates Brian and Gabby’s trip, so its creation does not necessarily have anything to do with the unfortunate events that unfolded after that. I know that some of the wording used in the letter is unfortunate and may indicate that they have some kind of connection, but this is not the case,” defense lawyer P. Matthew Luca said in court.

DEADLINES IN CASE

Reilly countered that the letter was undated and the jury should decide if it was relevant to the case.

“The language in this letter is killer and there is a reference in this letter to bring a shovel and bury the body,” Reilly said during Tuesday’s hearing.

Gabby’s family lawyer wants to ask Roberta Laundry about the deposition letter, he said.

Judge Danielle Brewer said on Tuesday: “I don’t see how this can be irrelevant.”

Plaintiffs will request it again as part of the discovery process.

Petito’s family attorney cited the note in a recent lawsuit asking for more evidence.

Reilly, in his request, said: “This request will also include a note that Roberta Londry wrote to Brian Londry in which she offered to bring a shovel to help bury the body. This note was released to the custody of Mr. Bertolino on Friday, June 24, 2022, by the FBI,” the court said in a statement.

Reilly has since said that he received letters from a laundry lawyer threatening to sue him for defamation in response to a request to obtain the original of the letter.

The lawsuit, filed by Petito’s parents, alleges Roberta and Christopher Laundry’s outrageous behavior of intentionally inflicting emotional stress during Gabby’s disappearance. The couple refused to return calls or text messages to Petito’s family as they were desperate to find their daughter, the report said.

The laundries have responded to lawsuits by claiming that they have no obligations to the Petito family.

The hearing of the case is scheduled for August.
