Check: Can You Get a Traffic Ticket Even Without No Parking Signs in San Antonio?

Many received them on E. Elmira Street near Zhemchuzhina.

SAN ANTONIO. With so many streets in San Antonio where construction is taking place, there can be some confusion when it comes to parking in these areas, often resulting in a fine. The Pearl is one of those places where people flock not only on weekends, but also on weekdays. And recent construction has caused a parking headache. Which brings us to today’s lawsuit filed by Michael McLeroy.

QUESTION

Can the San Antonio Police Department issue a ticket for every vehicle parked on the side of East Elmira Street near the Pearl, even if there are no NO PARKING signs or no parking warning signs?

SOURCES

  • City of San Antonio Parking Authority

ANSWER

It's right.

WHAT WE FOUND

McLeroy went on to say that many employees at Pearl’s businesses use the curb as parking because employee parking is usually full. And on at least two occasions, each vehicle had a ticket by the curb.

Rebecca Schneicker says she has one too. She told us, “There are no parking signs along this side of the street. I’ve lived in San Antonio for a very long time and I’ve never seen parking tickets handed out on this street.”

The City of San Antonio Parking Authority responded to our inquiry on this matter, stating, “Officers have witnessed multiple security issues in the area with vehicles parked in narrow lanes obstructing traffic. . 19-38. (a) 6 – Obstruction of traffic. If a person wants to appeal a fine, additional information is provided on the ticket.”

So yes, it’s true. The City of San Antonio Parking Authority (not SAPD) may issue tickets for vehicles on a street without No Parking signs if they obstruct traffic.

But, city officials said, those tickets can be challenged in San Antonio Municipal Court.
