A student of the best high school in New York was sexually abused by a classmate: suit

According to a new lawsuit, an 11th grade student at one of New York City’s top non-specialized public schools alleges she was sexually assaulted in the bathroom by a classmate who filmed the incident and sent it to other students.

A teenage girl named “Jane Doe” was questioned about the video by the deputy director of the New York Laboratory School for Collaborative Research, who did not bother to notify her parents, school counselor, or police before questioning her. The Manhattan Supreme Court lawsuit alleges.

“Regardless of status [Doe] as a minor victim of sexual abuse or her apparent emotional and psychological trauma, [the assistant principal] forced [her] write a statement describing her sexual abuse,” the lawsuit says.

It happened while she was alone in the assistant director’s office “and without the support of an injury expert, thereby re-injuring her,” the statement said Friday.

Doe says that “unbeknownst to her” on November 4, 2021, a student at West 17th Street School in Chelsea followed her to the girls’ restroom on the first floor, where he raped her.

There was no guard or supervisor in the bathroom, and the teenage boy claimed to be standing between her and the bathroom exit, the lawsuit alleges.

The alleged assailant, who is listed as N.R. in court documents, “demanded” that the girl perform oral sex on him, which she said she did not want to do, according to the lawsuit.

HP “forced [her] into a toilet stall,” pushed her to the floor, “held her by the back of her head,” and forced her to have sexual intercourse, all without her consent, charges in the lawsuit.

Later that day, Doe discovered that N.R. recorded the incident on his mobile phone, showed it and sent it to other students, court documents say.

The deputy principal found out about the HP video and showing it to others and dragged Doe out of class to question her about it, the lawsuit says.

The girl and her father, identified only as Joe Doe in court documents, allege that the school was negligent in failing to protect her, especially since her father had previously reported that his daughter was the victim of bullying and was physically abused by another. student in October 2019, court documents allege.

Doe’s father even asked to be transferred after a previous incident, but the assistant director, who is not named as a defendant in the lawsuit, did not approve of the move, the statement said.

The lawsuit alleges that the school was also negligent in not properly investigating and reporting the sexual assault, and failing to look after the hallways and bathrooms.

In addition, it was known that N.R. was a troubled student who “had a reputation for dangerous behaviour,” the lawsuit alleges.

The father and daughter are suing the city and the Department of Education for unspecified damages.

They ask the judge not to reveal their identity as they are from an Islamic country in the Middle East. The duo fear that the daughter could be executed if she returns home and the country finds out about the sexual abuse.

In December 2021, The Post found NYC Lab to be among the top 12 non-specialized schools in the Big Apple, with a 98% graduation rate.

The City Law Department, Department of Energy and Deputy Director Jason Koch did not respond to requests for comment Tuesday.
